1. Agreement to Terms
By accessing or using OneMind at onemind.life ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.
These Terms constitute a legally binding agreement between you and OneMind (operated by Joel Castro, "we," "us," or "our").
2. Description of Service
OneMind is a collective alignment platform where groups reach consensus through anonymous deliberation.
How it works:
- Someone poses a question or topic
- Participants submit propositions (anonymously)
- Participants rate each other's propositions
- The highest-rated proposition wins the round
- If it wins consecutive rounds, consensus is reached
Key features:
- Anonymous proposition submission
- Democratic rating and voting
- AI-assisted proposition generation (optional, per chat)
- No account or email required
3. Eligibility
You must be at least 13 years old to use OneMind.
By using the Service, you represent and warrant that:
- You are at least 13 years of age
- You have the legal capacity to enter into these Terms
- You are not prohibited from using the Service under any applicable law
4. User Accounts and Identity
4.1 Anonymous Access
OneMind does not require an account. You are identified by a randomly generated device identifier.
4.2 Display Names
You may choose a display name for participation in chats. You agree not to:
- Impersonate any person or entity
- Use a name that is offensive, misleading, or violates others' rights
4.3 Account Security
You are responsible for:
- Maintaining the security of your device
- All activities that occur under your device identifier
5. Acceptable Use
5.1 You Agree To:
- Use OneMind for lawful purposes only
- Respect other participants' right to anonymous deliberation
- Submit propositions in good faith
- Follow the rules of individual chats (set by chat hosts)
5.2 You May NOT:
- Submit content that is illegal, threatening, harassing, defamatory, obscene, or harmful
- Attempt to deanonymize other participants
- Spam, flood, or disrupt chats
- Circumvent rate limits, security measures, or access controls
- Use OneMind to organize or facilitate illegal activities
- Scrape, harvest, or collect data from the platform
- Reverse engineer, decompile, or attempt to extract source code (except as permitted by applicable law or the AGPL-3.0 license)
- Use automated systems (bots) to interact with the Service without authorization
- Interfere with or disrupt the integrity or performance of the Service
Violations may result in immediate termination of access.
6. Content and Propositions
6.1 Your Content
When you submit propositions or other content to OneMind:
- You retain ownership of your content
- You grant OneMind a worldwide, non-exclusive, royalty-free license to use, display, store, and process your content as necessary to provide the Service
- You represent that you have the right to submit such content
6.2 Anonymous Propositions
- Propositions are displayed anonymously to other participants
- You cannot see who submitted which proposition (except your own)
- This anonymity is a core feature of OneMind
6.3 AI-Generated Content
Some chats may include AI-generated propositions:
- Powered by Anthropic Claude
- Participate equally in voting
- Are not visually distinguished from human propositions
- May be enabled or disabled by chat hosts
By using OneMind, you acknowledge and consent to interaction with AI-generated content.
6.4 Content Moderation
- We do not actively monitor or moderate all content
- Chat hosts may have moderation capabilities within their chats
- We reserve the right to remove content that violates these Terms
- We may report illegal content to law enforcement
6.5 No Endorsement
We do not endorse any content submitted by users. Content represents the views of individual users, not OneMind.
7. Consensus and Outcomes
7.1 Nature of Consensus
Consensus reached on OneMind represents agreement among participants within the platform. It is:
- A tool for collective deliberation
- Non-binding unless participants independently choose to act on it
- Not a legal contract, vote, or enforceable decision
7.2 No Guarantees
We do not guarantee:
- That consensus will be reached
- That outcomes will be fair, accurate, or representative
- That the Service will be suitable for any particular purpose
7.3 Finality of Results
Once consensus is reached (same proposition wins consecutive rounds), the result is recorded and cannot be appealed through OneMind.
8. Credits and Payments (If Enabled)
8.1 Credits System
OneMind may offer a credits system for premium features. If enabled:
- Certain features may require credits (if the credits system is active)
- Credits may be purchased through Stripe or another payment processor
- Prices are displayed at time of purchase
8.2 Refund Policy
- Credits are generally non-refundable
- Refunds may be issued at our discretion for technical issues
- Chargebacks or payment disputes may result in account suspension
8.3 Free Features
- Joining chats and participating (submitting propositions, rating) is free
- Creating chats or enabling certain features may require credits
8.4 Price Changes
We reserve the right to modify pricing. Changes will not affect previously purchased credits.
9. Intellectual Property
9.1 OneMind Platform
The OneMind platform, including its design, features, and underlying code, is:
- Owned by OneMind / Joel Castro
- Licensed under AGPL-3.0 (open source)
- Available at: https://github.com/OneMindLife/OneMind.Life
You may use, modify, and distribute the source code in accordance with the AGPL-3.0 license.
9.2 Trademarks
"OneMind" and associated logos are trademarks of OneMind. You may not use them without permission.
9.3 User Content
You retain ownership of your propositions. Consensus outcomes are shared among participants.
10. Privacy
Your privacy is important to us. Please review our Privacy Policy for information about:
- What data we collect
- How we use your information
- Third-party services we use
- Your privacy rights
11. Third-Party Services
OneMind integrates with third-party services:
- Supabase — Database and authentication
- Anthropic — AI proposition generation
- Stripe — Payment processing
- Firebase — Analytics
- Sentry — Error tracking
Your use of these services is subject to their respective terms and privacy policies.
12. Disclaimers
12.1 "As Is" Basis
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
12.2 No Warranty
We disclaim all warranties, including but not limited to:
- Merchantability
- Fitness for a particular purpose
- Non-infringement
- Accuracy or reliability of results
- Uninterrupted or error-free operation
12.3 Use at Your Own Risk
You use OneMind at your own risk. We are not responsible for:
- Decisions made based on consensus results
- Actions taken by other users
- Content submitted by users or AI
- Technical failures or data loss
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
13.1 No Indirect Damages
WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING:
- Loss of profits, data, or goodwill
- Service interruption
- Computer damage or system failure
13.2 Liability Cap
OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF:
- The amount you paid us in the 12 months preceding the claim, OR
- $100 USD
13.3 Exceptions
Some jurisdictions do not allow limitation of liability for certain damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.
14. Indemnification
You agree to indemnify, defend, and hold harmless OneMind and its operators from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any third-party rights
- Content you submit to the Service
15. Dispute Resolution
15.1 Informal Resolution
Before filing a formal dispute, you agree to contact us at joel@onemind.life and attempt to resolve the dispute informally for at least 30 days.
15.2 Arbitration Agreement
If informal resolution fails, any dispute shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.
15.3 Class Action Waiver
YOU AGREE TO RESOLVE DISPUTES INDIVIDUALLY. You waive any right to participate in a class action, class arbitration, or representative action.
15.4 Exceptions
The following disputes are NOT subject to arbitration:
- Claims in small claims court (if eligible)
- Intellectual property disputes
- Claims for injunctive relief
15.5 Opt-Out
You may opt out of arbitration by sending written notice to joel@onemind.life within 30 days of first using the Service.
16. Termination
16.1 By You
You may stop using OneMind at any time. Uninstalling the app removes your local device identifier.
16.2 By Us
We may suspend or terminate your access:
- For violation of these Terms
- For illegal activity
- For any reason, with or without notice
16.3 Effect of Termination
Upon termination:
- Your right to use the Service ends immediately
- Provisions that should survive (indemnification, limitation of liability, dispute resolution) remain in effect
17. Changes to Terms
We may modify these Terms at any time. When we do:
- We will update the "Last Updated" date
- We will notify users of material changes through the app or website
- Continued use after changes constitutes acceptance
If you disagree with changes, stop using the Service.
18. General Provisions
18.1 Governing Law
These Terms are governed by the laws of the Commonwealth of Pennsylvania, United States, without regard to conflict of law principles.
18.2 Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and OneMind.
18.3 Severability
If any provision is found unenforceable, the remaining provisions remain in effect.
18.4 Waiver
Failure to enforce any provision does not constitute a waiver of that provision.
18.5 Assignment
We may assign these Terms. You may not assign your rights without our consent.
18.6 Force Majeure
We are not liable for failures due to circumstances beyond our reasonable control.
